Guest Terms and Conditions Guest Holiday Let Agreement for All Rental Properties This contract sets out the terms upon which AMRP Holiday Lets Limited will provide a serviced apartment or house to you as set out on the booking form (“Accommodation”). This contract is between the person who is the signatory to this Agreement (“You”) and AMRP Holiday Lets Limited. 1. Booking Confirmation To reserve Accommodation AMRP Holiday Lets Limited will require 100% of the total amount due. Failure to pay in accordance with the agreed terms of payment may result in suspension of Accommodation. AMRP Holiday Lets Limited reserve the right to charge interest on overdue accounts. 2. Method of Payment AMRP Holiday Lets Limited accept the following methods of payment:- • Credit/Debit Card: Visa, MasterCard, & American Express. • Bank Transfer: Pounds sterling. Bank details available on request. 3. Booking Extensions If you wish to extend your stay we will accommodate the request should we have availability. Payment must be made immediately on invoice. Failure to do so will result in a clean being schedule for the original day of check out. 4. Accommodation You are only granted a licence to occupy the Accommodation and this agreement gives you no other rights either express or implied to the Accommodation. 5. Occupancy The number of people permitted to occupy each apartment is limited to the number of beds, or and sofa beds. In some properties extra sleeping accommodation can be arranged. If the number of people permitted to occupy a property is exceeded, AMRP Holiday Lets Limited reserve the right to charge for additional guests at the rate of £100 per guest per night or additional guests will have to vacate the property. 6. Duty of Care/Responsibility It is the responsibility of the Guest to ensure they are respectful to other tenants living within the building/area in which they are staying. Guests must also ensure noise levels are restricted. Reports of excess noise from other tenants to the Agent or neighbouring properties will mean automatic immediate termination of the stay. In addition, Guests have a responsibility and duty of care to ensure damage is not deliberately inflicted on the property or its contents. Smoking is prohibited and any evidence of this in the apartment will incur penalties. Such damages will be charged to the Guest via invoice payable within 7 working days. 7. Arrivals and Departures Guests can check in to their apartment from 2pm on the day of arrival. On arrival you will be asked to check the Accommodation and accept your stay. Check out is at 11 am on the day of departure. Please note you will be charged £20.00 per 15 minutes for checking out late. Key collection details will be provided prior to check-in date and will not be released until this contract has been signed, online check in form submitted and identification of the lead booker submitted, this must detail the lead bookers home address. Early Departures In the event that a guest needs to check out prior to the agreed departure date, AMRP Holiday Lets Limited will class the departure as the end of the stay and arrange for the property to be cleaned. Guests found checking in early without authorisation may be subject to additional charges. Please make sure you are checked out by 11am at least for cleaning. 8. Inventory / Property Care All damages, over and above the deposit amount, will be paid for by the guest within 7 days of receiving the invoice from AMRP Holiday Lets Limited. Failure to do so will result in a small claims court claim being filed on the next working day after the deadline. All interest, legal fees and any other charges related to recouping the outstanding debt will be paid for by the guest. 9. Additional Charges Broadband: Broadband is available free in all property locations. Pass codes will be provided on check in. However, AMRP Holiday Lets Limited will not be responsible for any fault associated with the user’s hardware or software and no support will be available and AMRP Holiday Lets Limited will not provide compensation in any form for its failure to work. Cleaning: AMRP Holiday Lets Limited expects the property to be left in a reasonable state on departure. If, at AMRP Holiday Lets Limited discretion, additional cleaning is required on departure, the cost of this cleaning will be an additional charge, again invoiced and payable within 7 days. Smoking: Smoking is prohibited in all apartments and communal areas. In July 2007, smoking was made illegal in enclosed public areas; this includes the communal hallways as they are used by all residents and their guests. Anyone found to be smoking or evidence of smoking in the apartments or communal areas will incur a £100 charge by way of Liability to cover the additional costs of cleaning, freshening and airing the Apartment over a 24 hour period. Any damages caused will be charged for in addition to this fee, again invoiced and payable within 7 days. Keys: AMRP Holiday Lets Limited will issue the guest with one set of keys. Additional sets can be supplied subject to availability and the request must be made in advance of arrival. However, if the issued keys are not returned on departure we reserve the right to charge the guest or booker for the replacement of keys or changing the locks. The cost of replacement keys will be £100.00. The cost for replacing the locks will be no less than £100.00 whichever AMRP Holiday Lets Limited deem the quickest way of gaining access to the apartment. In such event, AMRP Holiday Lets Limited also reserve the right to charge the guest for further nights stay should it be the case that we are unable to gain access to the property and re-let it. Parking Pass: AMRP Holiday Lets Limited will issue the guest with a parking pass (for those properties requiring permits only) which must be left in the apartment upon departure. Failure to return the pass will result in a replacement charge of £150.00. Call Outs: If the emergency call out number is used to call out AMRP Holiday Lets Limited staff between the hours of 9 pm and 9 am for any purpose other than an emergency, AMRP Holiday Lets Limited reserve the right to charge the booker or guest a call out fee of £100. 10. Liability AMRP Holiday Lets Limited cannot be held responsible in any way for loss of or damage to, contents, furniture, fittings or any personal belongings at the apartment locations. Nor can AMRP Holiday Lets Limited be held liable for the acts or defaults caused by third parties. You are advised to ensure your own insurance policies cover loss or damage to personal property during your stay. Guests are advised to take out adequate travel and personal insurance. 11. Access to Properties In addition to the weekly housekeeping service, AMRP Holiday Lets Limited on occasion may need to access the property in which you are staying. AMRP Holiday Lets Limited reserve the right to gain access to all properties at all times. We will, wherever possible, endeavour to give guests as much notice as possible prior to entering the apartment 12. Pets AMRP Holiday Lets Limited regret that pets are not allowed in the apartments, unless prior agreed and a cleaning deposit paid in advance of stay. 13. Services AMRP Holiday Lets Limited cannot be held responsible for any failure or interruption of services to the property, including electricity and water or any damage, disruption or noise caused as a result of repair works being carried out in another part of the property or development. 14. Communication AMRP Holiday Lets Limited operates between the hours of 9am and 8pm 7 days a week. If you are checking in after these times please call ahead during office hours to ensure you have everything you need, a mobile number will be provided to you in advance of stay and in your welcome pack within the property. 15. Charges Depending on the source of your booking you may or may not be asked to pay a damage waiver. In either case the lead guest takes full responsibility for any damage or additional charges and accepts that they will be the named person on the invoice and the liability to pay rests solely with them. The lead guest also agrees to settle the invoice within 7 days and accepts that failure to do so will result in interest charged at 8% per day for every day that passes that the invoice is unsettled, plus any fees incurred to recover the debt. The initial damage will be deducted from the credit card held on file and you give full authorisation for this to happen whilst accepting that anything not recovered by the will be paid in full by you, the lead guest, within 7 days of the invoice being issued. Charges incurred due to damage of the property will be as follows and the lead guest accepts full responsibility to these charges in the event of any damage found by AMRP Holiday Lets Limited: • Cost of the damage to be repaired in full. • 25% administration charge to organise the repairs. • Up to 5 nights of the rental amount in the event that we are unable to rent the property out to a future guest due to the damage caused. • Relocation costs of any guests due after your stay that can not stay due to the damage of the property. 16. Entire Agreement This Agreement shall be governed by the laws of England and Wales and the Parties submit to the exclusive jurisdiction of the English Courts and the Apartment Form is the complete and exclusive statement of the Agreement between the parties relating to the subject matter of the Agreement which supersedes all previous communications, agreements or other arrangements written or oral. 17. Non Availability of the Property Non-availability of Property: If for any reason the property is not available on the date booked, or the property is unsuitable for holiday letting, all rent and charges paid in advance by the Guest will be refunded in full, but the Guest or any member of their group shall have no further claim against AMRP Holiday Lets Limited. 18. Right to Refuse The Company reserves the right to refuse any booking. 19. Cancellation AMRP Holiday Lets Limited reserves the right to cancel or alter arrangements made for the Guest whether before or during the relevant Holiday Period, in any circumstance which arises from or is attributable to acts, events, omissions or accidents beyond the reasonable control of AMRP Holiday Lets Limited or where in the reasonable opinion of AMRP Holiday Lets Limited it is deemed necessary to perform or complete essential remedial or refurbishment works. If a booking has to be cancelled by AMRP Holiday Lets Limited for the reasons above, it will take reasonable steps to offer an alternative booking. If AMRP Holiday Lets Limited is not able to offer such an alternative or the Guest does not accept the alternative offered or the altered holiday arrangements (as the case may be), AMRP Holiday Lets Limited will return to the Guest the relevant proportion of the money paid by the Guest in respect of the Accommodation and will not otherwise be liable for any loss caused by cancellation or alteration. 20. Utilities / Services Unless otherwise stated in writing, the holiday price will include all charges for the reasonable and responsible use of water, gas, electricity, and/or oil. Any damage or expense caused by the unreasonable and excessive use of utilities, will be charged to the Guest. Unless otherwise stated in the Property listing on the Company’s website or otherwise agreed in writing by the Company or Owner, electric cars and other vehicles are not to be charged using the property’s electricity supply or any EV charging point that may be installed at the property. If a Guest or member of their party is found to have done so, the cost will be charged to the Guest along with an administration fee of £25. 21. Brochure and Marketing Materials We make every effort to ensure that the information provided in our marketing is both accurate and is presented accurately on our website, in our brochure and in any other promotional material we may use. However, details and prices may be subject to change and errors do occasionally occur, so you must check all the details and arrangements with us at the time of booking. Sometimes changes to services or facilities at a property may occur after the booking has been made and may be unforeseen (i.e. damage damaged caused by a previous guest or an appliance breakdown); in this instance and where we are made aware we will let you know as soon as possible. Unfortunately we cannot accept responsibility for any inaccurate or misleading information given regarding the property or its facilities. It expressly agrees that no variation of this Agreement shall be effective unless in writing and signed by a duly authorised signatory of both parties. Check in is strictly at 2:00 pm for ALL guests unless prior approval has been agreed with us. I acknowledge that failure to comply with any of the terms outlined in this Guest Agreement may result in additional charges, eviction from the property, and forfeiture of my security deposit. I confirm that I have had the opportunity to ask any questions and seek clarification on any aspects of the agreement before signing this confirmation, whereby I agree to be bound by all terms and conditions included in the agreement.
